Uy calls Abante proclamation as “unconstitutional”

THE legal counsel of winning Manila 6th District candidate Joey Uy called the proclamation of Benny Abante as the winner in the 2025 midterm polls for the aforementioned district as “unconstitutional.”

Atty. Edward Gialogo, Uy’s legal counsel, pointed out that the Commission on Elections (Comelec) no longer has the power to revoke Uy’s victory because he has already been proclaimed and sworn in.

According to him, the House of Representatives Electoral Tribunal (HRET) should have jurisdiction over the matter.

Uy’s camp insisted that the Certificate of Finality issued by the Comelec is illegal and unconstitutional.

The lawyer said they have two petitions pending before the Supreme Court to implement its resolution and order the House to recognize Uy as a congressman.

Uy’s camp is confident that the Supreme Court will side with them and that it will respect the Constitution and the rule of law.

Aside from being a legal matter, Comelec Chairman George Garcia said this would also include the issue of membership in Congress, which only the House of Representatives has the power to resolve.

The Comelec is also monitoring the steps that Congress and the Supreme Court will take regarding the issue.
