Pansamantalang pinigilan ng Department of Justice (DOJ) ang pagpapalaya ng Olongapo City Regional Trial Court (RTC) kay US Marine Lance Corporal Joseph Scott Pemberton habang nireresolba pa ang inihaing Motion for Reconsideration (MR).
Ayon kay Presidential Spokesperson Secretary Harry Roque, ang naturang hakbang ay mismong isinagawa ng DOJ base na rin sa kahilingan ni Bureau of Corrections (BuCor) Director General Gerald Bantag na idaan muna sa wastong pag proseso.
“Just in po, I will just read the text po of our BuCor chief. And I will quote, ‘By the way, Sir, advise ng DOJ, hindi ipa-process ang release, this is referring to Pemberton, since there was an MR filed and we’ll just wait for the resolution of the MR,” saad ni Roque.
“Armed Forces of the Philippines spokesperson General Edgard Arevalo, please await resolution of the MR before releasing Pemberton,” dagdag pa ni Roque.
Mismong si Roque din ang nagsabi na ang kautusan ng Olongapo City RTC Branch 74 na palayain si Pemberton ay isang “judicial overreach”.
Si Pemberton ay na convict ng korte dahil sa salang pagpatay kay Filipino transgender woman na si Jennifer Laude sa isang hotel sa Olongapo City noong taong 2014 kung saan si Roque ang naging lead counsel para sa kampo ni Laude.
Batay sa kautusan ng RTC Branch 74, natapos na anya ang may 10-taong maximum penalty na binuno ni Pemberton sa loob ng custodial facility sa kampo Aguinaldo matapos pumasa ito sa good conduct time allowances (GCTA).
