PINAKAKASUHAN na ng Department of Justice ng paglabag sa Republic Act 9165 o Comprehensive Dangerous Drugs Act of 2002 si self-confessed drug lord Rolan Eslabon Espinosa o Kerwin Espinosa gayundin ang 10 iba pa kaugnay ng umano’y illegal drug trade sa Eastern Visayas.
Sa resolusyon ng DOJ panel of prosecutors, maliban kay Espinosa ay kinasuhan din sina Marcelo Adorco, Jose Antipuesto alyas Joe; Jose Estrera alyas Amang; Galo Stephen Bobares, Ferdinand Rondina alyas Denan; Brian Anthony Zaldivar alyas Tonypet; Nickjune Canin, Virbeca Diano alyas Bebeth, Alfred Cres Batistis at Josela Dumaguit alyas Jojie.
Ang pagsasampa ng kaso ay batay sa tinatawag na extrajudicial confessions ng ilan sa mga respondent hinggil sa kanilang partisipasyon sa illegal drug trade.
Bagamat may ilan ang bumaligtad sa kanilang pag-amin, naniniwala ang DOJ panel of prosecutors na hindi sapat ang kanilang pagbawi sa kinalaman sa krimen.
“A reading of the affidavits of respondents Kerwin, Adorco, Antipuesto, Bobares, Rondina, Zaldivar, Diano, Estrera, Canin, Batistis, and Dumaguit, shows that the same contain statements wherein the affiants described their respective participation in the illegal drug trade of respondent Kerwin which partake in the nature of extrajudicial confessions, i.e. out of court confessions,” ayon sa resolusyon ng DOJ.
“Clearly, due to the complexities of transactions alleged in the instant case wherein respondent Kerwin would direct his couriers to make deliveries to pushers, users or suppliers, and likewise make payment, whether through text messages or phone calls, or through a second or third middleman, it is sufficient that the communications among and between the respondents are established to prove the illegal drug trade,” dagdag nito.
Inabswelto naman sa reklamo dahil sa kakulangan ng batayan o probable cause laban kay Police General Asher Dolina at sa iba pang pulis na sina Chief Inspector Wilfredo Abordo, Chief Inspector Eufracio Javines, PO3 Dennis Torrefiel, Police Captain Bernie Magamay, Police Staff Sergeants Eduardo Betuin, Roberto Arafol, at Marvin Parac, Police Senior Supt. Elizar Egloso.
Lusot na rin sa kaso ang iba pa na kinabibilangan nina Maba Limbona, Galo Legaspi, Baysay Custodio, Victor Espina, Martin Espina, at Marites Ang.
